Cherry Soft is the owner and operator of the DWEXO platform.

2Description of the Service

DWEXO is a SaaS platform that enables companies to manage their activities through various modules, including:

• CRM and sales management
• Purchasing, sales, and invoicing
• Financial management
• Document management
• Collaborative tools (chat, tasks, calendar, drive)
• Industry-specific modules depending on the subscribed offer

Accessible features depend on the subscription plan chosen by the Client.

3Access to the Service

Access to DWEXO requires the creation of a user account. The User undertakes to:

• Provide accurate and up-to-date information
• Keep login credentials confidential
• Not share access with third parties

Cherry Soft reserves the right to suspend or restrict access in case of non-compliant use.

4Authorized Use

The User agrees to use DWEXO exclusively for:

• Professional purposes
• Lawful activities
• In compliance with these Terms

Any abusive, fraudulent, or illegal use is strictly prohibited.

5Liability

5.1 User Liability

The Client is solely responsible for:

• Data entered into DWEXO
• The accuracy, legality, and compliance of such data
• Actions performed by its users

5.2 Cherry Soft Liability

Cherry Soft implements reasonable means to ensure:

• Service availability
• Data security
• Correction of reported malfunctions

Cherry Soft does not guarantee uninterrupted service.

6Personal Data

Personal data are processed in accordance with the DWEXO Privacy Policy, available on the website and the platform.

7Intellectual Property

The DWEXO platform, its components, trademarks, logos, content, and source code are the exclusive property of Cherry Soft.

Any unauthorized reproduction or use is prohibited.

8Suspension and Termination

Cherry Soft may suspend or terminate an account in case of violation of these Terms.

The Client may request account closure in accordance with the applicable commercial conditions.

9Service Evolution

Cherry Soft reserves the right to modify and improve the features, interface, and infrastructure of the service.

Any material change to these Terms will be communicated to Users.

10Governing Law and Jurisdiction

These Terms are governed by Tunisian law.

Any dispute shall fall under the exclusive jurisdiction of Tunisian courts.

11Service Availability (SLA)

Cherry Soft uses reasonable technical and organizational means to ensure high availability of the DWEXO platform.

The platform is provided as a SaaS service accessible 24/7, subject to scheduled maintenance periods and events beyond Cherry Soft's control.

The following are excluded from the availability calculation:

• Scheduled maintenance operations
• Corrective or evolutionary update operations
• Force majeure events
• Failures attributable to communication networks, Internet service providers, or Client equipment

Whenever possible, scheduled maintenance operations will be communicated in advance via the platform or by any appropriate means.

In the event of major service unavailability, Cherry Soft undertakes to mobilize its teams to restore the service as quickly as possible.

No automatic financial compensation shall be due in case of temporary service unavailability. Cherry Soft's liability may only be engaged under the conditions set forth in the article relating to liability.
